Terms of Service

These Terms of Service ("Terms") govern your use of Watch Assistant (the "App"). "We", "us", and "our" refer to the operator of the App. By installing or using the App you agree to these Terms. If you do not agree, do not use the App.

1. The service

Watch Assistant is an AI-powered voice and text assistant for Apple Watch and iPhone. The App relays your queries to large language models and other providers to produce replies. Replies are generated automatically and may be inaccurate, incomplete, or out of date.

2. AI-generated content disclaimer

AI replies are provided "as is" for informational and convenience purposes. You are solely responsible for evaluating the accuracy and suitability of any reply for your situation. Do not rely on the App for medical, legal, financial, safety, or emergency decisions. For emergencies, contact your local emergency services. We make no representations or warranties about the accuracy, completeness, or fitness for purpose of any AI output.

3. Subscription, pricing, and renewal

The App offers an optional auto-renewing subscription that increases your monthly request quota and unlocks additional features. The current price is shown inside the App before purchase. Subscriptions are billed through your Apple ID, renew automatically at the end of each period unless cancelled at least 24 hours before the end of the period, and can be managed or cancelled in your iOS Settings → Apple ID → Subscriptions.

Refunds for App Store purchases are handled by Apple under their refund policy. We cannot issue App Store refunds directly.

4. Acceptable use

You agree not to use the App to:

• generate content that is unlawful, defamatory, harassing, hateful, or that infringes the rights of others;
• attempt to extract, reverse-engineer, or copy the underlying models or system prompts;
• probe, scan, or interfere with the backend or any of its sub-processors;
• automate the App in a way that exceeds reasonable individual use (e.g. scripted abuse of the request quota); or
• circumvent the App's safety, rate-limiting, or licensing controls.

We may suspend or terminate access for violations.

5. Your content

You retain ownership of the prompts you submit and the conversation history stored on your device. You grant us a limited, non-exclusive licence to process your prompts for the sole purpose of returning a reply, operating the service, and complying with law. We do not use your prompts to train AI models.

AI replies generated for you are made available for your personal use; we make no claim of ownership over those replies, but cannot represent that they are unique or free of third-party rights.

6. Third-party services

The App relies on third-party services (Apple, OpenAI, RevenueCat, a places-search provider, Vercel hosting). Their availability and behaviour are outside our control; outages or changes upstream may affect the App.

7. Privacy

Use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that replies will be accurate.

9. Limitation of liability

To the maximum extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with the App. Our total cumulative liability for any claim relating to the App will not exceed the greater of (a) the amount you paid for the App in the twelve months immediately preceding the event, or (b) USD 10.

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

10. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your access if you violate these Terms or if we discontinue the App.

11. Governing law

These Terms are governed by the laws of <<JURISDICTION>>, excluding its conflict-of-laws rules. Where mandatory consumer protection laws apply in your country of residence, those laws are not waived by this clause.

12. Changes

We may update these Terms; the updated version takes effect when posted with a new "Effective" date. Continued use after changes means you accept the updated Terms.

Your licence to the App is also subject to Apple's standard end-user licence agreement at apple.com/legal/internet-services/itunes/dev/stdeula, except as those terms are superseded by these Terms.
